This request for Expression of Interest follows the General Procurement Notice (GPN) for the Kenya IFPPP project that appeared in United Nation Development Business No. WB3876-07/13 of July 2013.
The Government of Kenya (GoK) has received financing from the World Bank towards the cost of the Infrastructure Finance and Public Private Partnerships Project (IFPPP) whose overall development objective is to increase private investment in the Kenyan infrastructure market by improving the enabling environment to generate a pipeline of bankable PPP projects.
It is intended that part of the proceeds of this credit be applied to eligible payments under the contracts for provision of the above Consultancy services and is for a period of twelve (12) months.
1. Objective
The objective of the consultancy is to provide the required Advisory Services to the Ministry of Health, relevant County Health Teams and the PPP Unit on key aspects of PPP Strategy development, specific project preparation, procurement, and contract negotiations for the health sector; Document and put in place a strategy for Stakeholder engagement, and implementation of Social and Environmental Safeguards under PPP Schemes; Support for capacity building for the Ministry Nodes and the relevant County Health Teams to enable them to carry out successful PPP transactions.
2. Scope of Work
The Scope of Work of this assignment will include, but is not limited to, provision of a range of advisory services to the PPP Nodes in the following:
(a) Development of a PPP strategy and Capacity Building:
• Providing technical input to assist Ministry of Health (MOH) to develop and implement a PPP strategy for the health sector;
• Building project preparation capacity in the MOH PPP Node and relevant staff including County staff where necessary;
• Advice to the PPP Node and County Health Teams on international exchange programs to facilitate the transfer of lessons learned regarding practices in other countries;
• Assisting in the design and implementation of a suitable strategy for stakeholder communication.
(b) PPP Project Identification, Pre-feasibility and Feasibility:
• Assist in the identification of a Health sector PPP pipeline of projects;
• Prepare a pre-feasibility and feasibility studies assessment framework and standard form ToRs for MOH PPP Node which can be applied for future reference; and
• actively participate in preparing and reviewing pre-feasibility and feasibility studies for health sector PPPs.
(c) Development of Transaction Advisor TORs, Contract Negotiation and Management:
• Providing necessary advice on the preparation of Terms of References (ToRs) for selection of Transaction Advisors;
• Advice and necessary support to the PPP Node in evaluation of Tenders and supervision of Transaction Advisors assigned to various projects;
• Advice on setting up successful framework and structure for negotiations to reach Commercial Close;
• Assisting the PPP Node and other relevant staff in MOH and Counties in the development of capacity in negotiation skills, strategy and tactics, including risk mitigation strategies and techniques; and
• assisting the PPP Node and Project Teams to set up a framework for monitoring compliance and performance of various Projects in the PPP Program.
(d) Stakeholder Engagement Strategy and Implementation:
• Carrying out wide and in-depth study of various categories of potential investors and institutions in Health and Financial sector,
• analyzing and recommending strategies to draw Investor interest, while applying other strategies as a means for stakeholder engagement, and
• assisting MOH and the PPP Node in developing and designing project information documents (prospectus), market testing, and organizing/scheduling of PPP Investor Conferences.
(e) Development and Implementation of Safeguards Strategies:
• Providing advice to local consultants on the preparation of project-specific Environment and Social Impact Assessments (ESIAs) and Resettlement Action Plans (RAPs) for Project Affected Persons (PAPs), all in accordance with the Environmental Management and Coordination (EMCA) Act 1999 and the Equator Principals;
• Advising PPP Node on stakeholder consultation for specific projects, including where appropriate, media relations and portfolio as part of community outreach strategies.
3. The National Treasury (the Client) through its Project Implementation Unit (PIU) now invites eligible individual consultants to express their interest in providing all the services.
Interested Consultants should provide information demonstrating that they have the required qualifications and relevant experience to perform the services.
Consultants should provide their most recent profiles showing their experience, qualifications, capabilities, references and details of past experience especially in the area of their expertise etc.
The shortlisting criteria are;
(a) Have at least 10 years relevant experience with at least 5 years specific experience working on Health related PPPs;
(b) Experience working with governments, particularly on health projects;
(c) Development of processes and systems for PPP project and PPP contract management;
(d) Development and implementation of PPP transactions;
(e) PPP capacity building for Government officials;
(f) Ability to assess a project’s financial and fiscal viability, and potential attractiveness to investors/providers;
(g) Strong financial modeling skills; and
(h) At least 3 years work experience in Sub-Saharan Africa.
4. The expression of interest is also open to interested firms who may wish to propose individual consultants. In such cases, only the experience and qualifications of the individuals proposed shall be taken into account in the selection process and not the firm’s corporate experience. Consequently, the ensuing contract agreement will be signed directly with the successful individual.
5. The attention of interested consultants is drawn to paragraph 1.9 of the World Bank’s Guidelines: Selection and Employment of Consultants [under IBRD Loans and IDA Credits & Grants] by World Bank Borrowers published in January 2011 (“Consultant Guidelines”), setting forth the World Bank’s policy on conflict of interest.
A consultant will be selected in accordance with the procedures for selection of individual consultants set out in the Consultant Guidelines.
